Tymoshenko Alleges Penitentiary Service Fabricated Her Refusal From Transfer …

Yulia Tymoshenko, a former prime minister and current leader of the Batkivschyna All-Ukrainian Association party, alleges the State Penitentiary Service fabricated her refusal from transfer to Kyiv fore attending a court session in the criminal case on the 1996 murder of businessman Yevhen Scherban, a Member of Parliament at the Verkhovna Rada of second convocation, reads a statement made by Tymoshenko’s press service.

“Yulia Tymoshenko underlined that the Penitentiary Service’s outgivings on her refusal to be transferred to Kyiv “are rudely fabricated”,” the statement said.

In the ex-PM’s opinion, Oksana Tsarevych, an investigating magistrate at the Pecherskyi District Court of Kyiv, encroaches on Tymoshenko’s right to defence and participation in the interrogation of witness Petro Kyrychenko.

Tymoshenko in her application, handed over to the Kyiv Appeal Court, says that Judge Tsarevich is not taking all necessary measures to sure the ex-premier’s presence in the courtroom, thus violating requirements of the national legislation and Article 6 of the European Convention on Human Rights.

Tymoshenko holds to be impossible examination of the witnesses in her absence and demands to facilitate her personal attendance of the trial on Mary 15, although not agreeing for participation in it via videoconference.

As Ukrainian News earlier reported, the Penitentiary Service has said Tymoshenko refused to be transferred to the Scherban case trial on Wednesday, May 15.

The sitting is to start at 4pm.
